1. Agreement to terms
By downloading, installing, or using the Sail Tactician app (the "App") on your Apple Watch and/or iPhone, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.
These Terms apply to all users — racers, coaches, and observers alike. They form a binding contract, so read them carefully.
2. License grant
Sail Tactician grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial racing and training purposes only. You may not:
- Reverse engineer, decompile, or disassemble the App, except as expressly permitted by applicable law.
- Copy, modify, or create derivative works of the App or its underlying code.
- Rent, lease, sublicense, sell, or otherwise transfer the App to a third party.
- Use the App for any commercial purpose — including paid coaching deliverables — without prior written permission.
- Remove or alter any copyright, trademark, or proprietary notices.
3. Acceptable use
You agree to use the App only for lawful purposes and in a way that does not infringe upon the rights of others or restrict their use and enjoyment of the App. Prohibited conduct includes:
- Using the App to gain an unfair advantage in violation of Racing Rules of Sailing or any class-specific rules. The App is a tool to improve your sailing — not to circumvent the rules.
- Harassing, threatening, or intimidating other users through any community feature we may offer.
- Attempting to interfere with the App's operation, security, or integrity.
- Violating any local, state, national, or international law or regulation.
4. Safety on the water
Sail Tactician is a tactical aid, not a navigation or safety device. You are responsible for safe operation of your boat at all times. Specifically:
- Always maintain a proper lookout. Do not stare at the watch or phone in close-quarters situations, near other boats, or in restricted waters.
- Use independent navigation tools (chartplotters, charts, compass) for any safety-critical decision.
- Comply with the Racing Rules of Sailing, the COLREGS, and the directions of race officials at all times.
- Do not rely on the App in conditions that exceed your boat's or your crew's capabilities.
5. Intellectual property
The App, including all content, features, and functionality — source code, algorithms, user interface design, graphics, and the Sail Tactician name and logo — is owned by Sail Tactician, its licensors, or other providers of such material, and is protected by United States and international copyright, trademark, and other intellectual property laws.
Your race tracks, polar curves, and personal settings remain yours. We claim no ownership over the data you generate using the App.
6. Warranty disclaimer
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. SAIL TACTICIAN MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE APP OR ITS FITNESS FOR ANY PARTICULAR PURPOSE. Specifically:
- We do not warrant that the App will be error-free, uninterrupted, or always available.
- We do not warrant the accuracy of race calculations, wind readings, line bias, layline projections, or performance metrics.
- We do not warrant compatibility with all device models, OS versions, or third-party accessories.
- Your use of the App is at your own risk.
7. Limitation of liability
To the fullest extent permitted by law, Sail Tactician shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or in connection with your use of the App, including but not limited to damages for loss of profits, data, or use, or for any damage to property or person — even if we have been advised of the possibility of such damages.
In no event shall our total liability to you exceed the amount you paid for the App in the twelve (12) months preceding the claim.
8. Indemnification
You agree to indemnify, defend, and hold harmless Sail Tactician and its officers, directors, employees, agents, and successors from any claims, damages, or costs (including reasonable attorneys' fees) arising out of your use of the App, your violation of these Terms, or your violation of any rights of a third party.
9. Third-party services
The App uses Apple's native services, including HealthKit, CoreLocation, CoreMotion, and WatchConnectivity. Your use of these services is subject to Apple's terms and conditions. Sail Tactician is not responsible for any third-party services or content.
10. App Store terms
Your use of the App through the Apple App Store is also governed by Apple's standard terms and conditions. In the event of a conflict between these Terms and the App Store terms, the more restrictive provision shall apply with respect to your conduct.
11. Subscription and payment
Sail Tactician is offered as an annual subscription. If you purchase a subscription:
- Subscription fees are billed through your Apple ID at the price disclosed on the App Store at time of purchase.
- Your subscription will automatically renew at the end of each term unless you cancel it in your App Store settings at least 24 hours before renewal.
- Refund requests must be made through Apple, not Sail Tactician — we have no ability to process App Store refunds.
- We reserve the right to change pricing for future renewal periods with at least 30 days' notice.
12. Termination
Your license to use the App is granted for as long as you comply with these Terms. We may terminate or suspend your license at any time if you violate these Terms or misuse the App. Upon termination, your right to use the App ceases immediately, though sections 5 through 8 survive termination.
13. Changes to the App and these Terms
Sail Tactician may update the App or these Terms at any time. We will notify you of material changes via the App Store, in-app notification, or by updating the "Last updated" date at the top of this page. Your continued use of the App after changes constitutes acceptance of the updated Terms.
14. Governing law and jurisdiction
These Terms are governed by the laws of the State of Ohio, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state and federal courts located in Montgomery County, Ohio (Dayton), and the parties consent to personal jurisdiction in those courts.
15. Severability
If any provision of these Terms is found by a court of competent jurisdiction to be invalid or unenforceable, that provision shall be severed, and the remaining provisions shall remain in full force and effect.
16. Entire agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sail Tactician regarding your use of the App and supersede any prior agreements or understandings, whether written or oral.
